Trademark Registration

Trademark registration is a process of registering a word, symbol, or design that is used to distinguish a product or service from those of other businesses. The trademark registration process can be broadly divided into the following steps:

Trademark Search: A trademark search is conducted to ensure that the trademark you wish to register is not already in use or similar to any existing trademarks.

Trademark Application: Once the trademark search is complete, the trademark application is filed with the Trademark Registrar. The application needs to contain details such as the name and address of the applicant, the trademark, and the class of goods or services.

Examination: The trademark application is then examined by the Trademark Registrar, who may raise objections or ask for clarifications.

Publication: If the trademark application is accepted, it is published in the Trademark Journal. If no objections are raised within the prescribed period, the trademark is registered.

Government Fees

The government fees for trademark registration and renewal depend on the number of classes of goods or services for which the trademark is registered. The fees for registration and renewal are as follows:

For individuals and startups: Rs. 4500 per class for registration and Rs. 9000 per class for renewal.

For companies: Rs. 9000 per class for registration and Rs. 18,000 per class for renewal.
